So yesterday I drove to Home Depot to grab a few things and I parked at the end of the lot thinking by doing so I wouldnt get door dings or anything... well during the 25 minutes or so I was in the store a shopping cart took revenge and bit my new Sonata.

After doing some research and talking to the store manager I found out that there was a witness who saw it happen and actually wrote down the tag number of the person who let the cart go rolling across the lot, It was a guy driving a BMW 745LS which ticks me off even more that it was a guy with an expensive car who didnt care or wasnt man enough to step up to pay for what he did. Based on what the witness told me the guy actually watched the cart hit my car and then walked down to get the cart off my car and saw the damage but continued to just walk away and he turned to the witness and said "oh well it ain't my car" thats when she got his tag number hoping it would help in finding this guy but even the police said theres no way to "go after him"

Unfortunatly I cant really do anything about it because it is being called accidental damage and it was not "criminal" I went to the police to see if they can help me pursue the guy who was careless but they said its a civil case and they cant help. They were more argumentive then helpful, and Ill chalk that up to this areas useless Police.

I'm planning to get it fixed under my insurance which thankfully I have really low deductables but I'm just sick that it happened period. My car is literally 1.5 weeks old and it only has 290 miles on it.

Here are a few pictures so you can see the damage, it dented the fender right on the fold and also cracked the paint on the underside of the lip, the frame of the cart also hit the one spoke on the rim and took a chunk out of the coating so I dont know if i will get a new rim out of it or not.

It sucks that the first pictures of my car are ones showing damage and not pictures of how beautiful my new Sonata is...

Hit? More like slammed!

Had I been the woman I would have been on the phone to the police right there. I have done it in the past and the cart droppers sure do get angry especially when you run up and take a picture of them! :whistling:

If you have an attorney friend, have them send this guy a letter stating that he was identified as the culprit that damaged your car and that you have a witness. Just may scare him into paying for your damage. No sense in you having to be responsible for it.

If all else falls, I'd make an appointment for a key to come into contact with his Bimmer. :whistling: But that's just how I'd handle that. YMMV.

Unfortunatly I have no access to DMV records so other then having a tag number I have no other contact info for this person, I wish I could send him a letter of some type as Ray said but I've hit a dead end.

I'm definatly upset and I would love to track this guys car down and leave him some beauty marks but then I think that it wasnt his car that caused the damage so why take it out on it.

I wish I could find this guy and confront him and have the pleasure of calling him a careless scumbag who has no respect for other people's property. Maybe then he would get me heated and give me a reason to punch him square in the face, but then I would be in legal trouble and its not really worth that. I really wish he would have just been man enough to pay up for the damage.

He knows it was a brand new car becuase he walked down to get the cart and I'm sure he saw the damage, I'm unfortunatly gonna have to utilize my insurance to cover the repairs to my car. I'm being told that its being written as "not at fault" so my rates wont go up but still I have to pay my deductable which @ $250 for collision isnt that bad but still a hefty little hit to the wallet.

That's horrible i wish there were more that could be done,And the part that really sucks is you were trying to be preventative by parking way out in the parking lot(i do the same).Some times I love being in my big truck and have seen people do the old cart roll and that is when i'm glad my truck sits up up high and the cart usually hits the bumper or bounces off the underside/frame of my truck.I once had a lady pull up into my back end which at the time had the heavy trailer hitch on and it shook my truck(I was parked) and the hitch went through her radiator causing loads of damage.Needless to say she jumped out yelling it was my fault for having the hitch on it she got no where when the cops showed and two of my buddy's confirmed her idiotic outrage.
But as I said before the truck will soon be gone and i will be in a sonata turbo and in the same boat trying to protect my investment,I guess parking will become an art form again..

thats awful.. well if you wanted to be real cynical you could put an add on craigslist or something with his plates & car type offering a $50 reward to his identity and location (if thats legal).. and what you do with that info after that is upto u :whistling:

Most, it not all Home-Owners insurance policys provide up to $500.00 for "damage to Property of Others", regardless of liability.

The language reads something like: Damage to Property of Others pays up to $500 for damage to property of others caused by you or your qualified family member when you or they are not legally liable.So if you can find the guy and he has Home, Condo or Renters insurance, this coverage would apply in your situation.

If you are going to file this incident on your insurance, your insurance company will go after this guy if there is any way legally for them to do so to recoup their money. Just give them all your info, place, time, license number of that guy, etc....

About 3 years ago my Lexus was struck in a casino parking garage by a drunk driver. Security guards heard the commotion, video cameras picked up his car slamming into mine and his license plate number. The casino was wonderful in letting me know who it was and what evidence they had (it happened around 6 a.m. and we were in our room asleep, nice wake-up call!!). The guy was stopped out on the highway b/c his car was so heavily damaged (arrested for DUI, hit and run). My insurance company paid for all my damage then went after him. About 6 months later I even got my deductible back after his insurance paid!!

I am very sorry to hear about that and see those pictures... I had something very similar happen to my Supra, so I empathize with you completely...

You may want to talk to your insurance company representative to see if the company is able to offer any leniency... The person who hit my car with a shopping cart wasn't photographed or anything, and I was the only witness (it was from a distance so he was able to leave before I could take action) so I had nothing at all to go with, but when I reported it to Progressive they told me that they would call it a hit and run and wave my deductable. They repaired the damage absolutely free of charge for me.

I'm sorry to hear that your car got dented! Some people just don't care. Working at a dealership I see some things and it seems like a certain percentage of people who own nice cars just simply don't care about their car or anyone else. If their car is trashed, they get a new one in a year.

I would see if you can get the info from the tag. There should be other ways to get it. Unfortunetly, I'm not sure what ways there are. I know insurance will cover it, but it's the principal.

I have pretty much exausted all my searching options and I continue to hit dead ends with trying to find the person. No one seems to want to help me with finding the tag info and even my insurance (Progressive) said they wont investigate it and they will just pay the claim. It sucks that I will have to pay the collision portion of my deductable but it beats having to pay for the whole repair out of my pocket.

I have friends in good places and one happens to be a body shop owner, he has fixed my cars in the past and has done amazing work. Not only does he own a body shop but its also a custom paint shop that specializes in very exspensive paint jobs for custom hot rods etc. I sometimes think my daily driver is out of place in his shop but I know its getting fixed by one of the best in the industry.

I will be glad when this is repaired and can be put behind me! thanks for the sympathy and advice everyone has given.

sorry to hear about the accident. it looks like a minor repair(other than the wheel. A paintless dent repair guy should be able to get the dent out and it's hard to tell if the scratches will rub out or not.

The one thing I find disturbing as a Sonata owner is the paint flaking off under the wheel opening. It leads me to believe the surface prep was incorrect. I know paint flakes, but it doesnt look like a hard enough hit to make it split and flake off the surface.

Good luck with the repairs and getting it back to new. I hate seeing results from negligent people.

Well its hard to see in the picture but it actually dented right on the fold and I think that is what caused the paint to crack. The witness said that the cart rolled down the parking lot and had some speed to it so with being told that and seeing the result of the cart hitting it sounds like it had some speed to it, plus home depot carts are all metal so they have some heft to them.

I doubt a paintless gut can get this out because like I said it is dented right on the fold of the fender, the wheel I'm hoping will get replaced because its near imposible to repaint hyper silver finish and that's out of a wheel repair specialist's mouth.

I have no doubt that my buddy will get it fixed and I'm sure when I get it back you will never know it happened.

As a former claims adjuster, I can't believe that your insurance company says they will not pursue the at fault party. Several reasons:

1) They are going to pay money out on the claim - they'd much prefer to have another party to collect from

2) There is an independent witness who wrote down the license plate number

3) The computer systems the insurance companies have are ridiculous. I could get a first name and last name of someone and I'd be able to find a 7 year history of residency, if they ever filed bankruptcy, driving citations, etc...

Bottom line, if someone at the insurance company is telling you they "can't do anything to find this person," I'd speak to a supervisor about it.

At the least they should make it no-fault and waive your deductible.
