Question Hyundai Settlement Refund/Exchange Program

Hyundai Settlement Refund/Exchange Program

Official Site: ocssettlement
Pay attention to page # 8

So I just received a notice from the Hyundai OCS Class Action Center, concerning the Occupant Classification System (OCS) problems with the 2006-08 Sonata, 2006-09 Azera, & 2007-09 Santa Fe, and what they are doing to solve the issue. The jist of the notice is that if you had the OCS calibration done, and are still not satisfied, and can produce a person who is at least 16yrs old and weighs at least 108lbs who has been a passenger in your vehicle and the OCS did not classify them correctly, then Hyundai may offer to refund the purchase price of your vehicle. Hyundai may also offer to exchange, and at your option will exchange, your vehicle for another Hyundai vehicle. Any offer to refund the purchase price or exchange your vehicle will be subject to:

* A mileage offset according to the vehicle's mileage on the date of the offer, based on a 120,000 mile vehicle lifespan; and
* Vehicle damage other than ordinary wear.

There are more details to this, so go click the link above. I have noticed my OCS doesn't always work correctly, and I just spoke to the previous owner of my vehicle and they stated that they never received the OCS recalibration recall notice Hyundai states they mailed out in 2008. So I am thinking of taking my car in now for the recalibration, and if still not happy, taking Hyundai up on their offer to exchange my vehicle for another, especially since my vehicle has relatively low miles for it's year.

Anyone else thinking about doing this? Any pro's and con's you can think of about this offer? I mean, besides giving up our wonderful V6 for a 4 cylinder?

Thanks for your input guys.

I would love to see the outcome. I have a 07 GLS that will hit 80K here in a couple of days. I have not received any mail though I dont believe. But I would like to see how this comes out.

Don't wait for an outcome, because if your not proactive they do state you will miss out on this. That was one of the reasons I posted this, because personally, it's scary to think the passenger airbag won't go off in an accident and something terrible happens because of that.

Here is the number they provided to find out if your vehicle is in the settlement: 1-877-277-0012. Of course, you also have to claim that the OCS is not working, even after having it recalibrated. For most with a problem with it, the OCS works sometimes, sometimes not, so the airbag light doesn't have to be on all the time to make your claim, if this is an issue for you.

When you call that number, just ask them to send you the settlement paperwork, or, it is all on the website link I provided. Remember, you have to call Hyundai Customer Connect Center within the latter of 30 days after the recalibration for Sonata models, or 30 days following the final approval of the class action settlement to be eligible for the potential repurchase program or exchange.

Glad you called. I just made an appointment with my nearest dealership to get the OCS calibration done. They said it's going to take about 3 days because they have to pull the passenger seat out, but they will provide a new sonata as a loaner car free of charge. I did verify with Hyundai today on the phone before I set up my appointment that I wouldn't be charged for anything, and they confirmed that, took my info, and gave me a case number.

If after the calibration the issue persists, such as with mine where the light sometimes works and other times doesn't, then I will try to get the vehicle exchange. I just hope their idea of a vehicle exchange isn't offering me an Accent, because that won't do.

HAHA...no that will NOT do. It better be another sonata, I can go for the money. I like my car...but am becoming a little more interested in the newer model.

That depends on whether you follow their rules. They were sued in court over this, and the settlement won't be finished until June, but Yes, if you follow their rules stipulated on page 8 of the link I provided above, they can either refund your purchase price or do a vehicle exchange if you are still not satisfied with the OCS results after the calibration, ie; the airbag light still comes on & off indiscriminately or never goes off.

Keep in mind this is a huge safety issue for vehicle owners. All it takes is one person dying due to the airbag not working properly, and gone will be years of good PR and advancements Hyundai has made in it's public perception, so they are handling this as best as possible to avoid anyone getting hurt, including them. That being said, I am not expecting them to give me anything, because I have seen how companies wiggle themselves out of doing what is right too many times before. So my attitude is always 'Expect the worst, but hope for the best.'

Again, you need to go to the website link I gave above and read everything, it doesn't take that long. Because as Hyundai states, if you don't follow their rules in good faith, they don't have to do anything.

I am in love with my 2006 too much to part with her. I will just start making my passengers sign a liability waiver :-)
