Default Got rear-ended yesterday...

I was at a complete stop at the light and a driver rear-ended me. I got her insurance, license and name but her car was just off the lot. With no plates or stickers and her policy started 1-24-13 yesterday. I called my insurance to claim but they said there might be some trouble because her insurance isn't in her name and was just given yesterday...

Any tips or advice? I hope she doesn't find a way to get out of this.

It shouldn't matter when the policy went into effect as long as it's valid it should cover the damage. If her policy is NOT valid (and you have full coverage) that's what collision coverage is for.

This is true..but I rather not have my own insurance go up. I'm just hoping everything goes well.

No police were called? In Ontario, if damage is over $1000, that is a requirement. The police report would clearly have shown she was at fault. There is definitely over $1000 damage on your car. Otherwise, it is her word againsy yours. A rear end hit is hard to explain away on her side, but stranger things have happened. Any witnesses?

i would have defiantly get a police report. if she does try to ignore the situation and her insurance doesnt pay you can bring her to court and have the police report to back you up so its in your favor.

It was my first time getting into a accident. When I got all her information I thought that was fine. And I felt like I didn't need to call the cops. But now I regret not calling the cops and always will call now.

My insurance company said they don't know whats going to happen until the other driver gives out her statement. I'm just hoping they don't pull a "he reserved into our car"

If you are the victim of a rear end accident, you are NOT at fault with any Insurance company. Your carrier will go after her and hers for the $$$ and you can also do small claims on her for the deductable.
