Many, if not most police departments will not take a report for a minor rear ender with no injuries if both parties appear to be sober and insured. Your option is to go to the police station and file a report in person.
Budget cuts...

Many places are like that here, too. Her insurance company can kick sand. They gave her a policy, a number for it, coverage, probably took a CC number from her and dated it for a day before. One hour or one year, she should be their problem.

If anything, I have text and witness that she "admitted" that she did hit me and offering me to pay cash for my damages and not to go through insurance.

In Houston, they have a self-reporting form. If you go to a HPD service center, ask for the blue report form. Fill it out, get a copy to the police and a copy to both your insurance companies.

If it didn't happen in the city limits, HCSD has a similar form, but I have never seen an original version, only a cheap copy (ironically, which I received from an HCSD deputy!).

And your insurance company can't raise your rates for getting struck by an uninsured or underinsured motorist.

As a police officer I can 100% attest that this is not factual.

She has to have insurance to drive it off the lot, and since the car was rear ended this is an open and shut case. Just don't try to pull some crap like, "I was rear ended but my headlight got affected" type stuff... insurance fraud is a felony and affects everyone.

Perhaps where you are. Here in Texas, police and deputies don't have to write a report even if they are responding to a 911 call. I had a Sheriff's Deputy refuse to write a report for an accident that totalled my car. He told us to use the self-reporting form.

I always include coverage for Uninsured and Underinsured Motorists on my car insurance policy and have used it twice when the other driver only carried the minimum amount of insurance required by the state and it didn't cover my losses (which included medical bills).
Since you were rear-ended, it will be tough for anyone, including your insurance company, to say you were at fault - it's just a matter of what ther other driver's policy will pay and whether that covers your costs.

Updated:
The other driver admitted to her insurance that she was at fault..now they are just waiting to talk to her mom. But Geico can't contact the mom, she isn't picking up her phone or something.

Update to the Update:
I just called Geico. They said if the person doesn't pick up by next monday, they will transfer my claim over to someone else. And I'm not even sure they will pay for all the damages to my car. I think its going to be about 2-3 more weeks before Geico even comes to look at my car...

Officer, with all due respect, your "not factual" statement falls somewhere between vague and ambiguous.

Which post are you refering to? The one I posted was derrived from personal experience.
